These Terms of Service ("Terms") govern your access to and use of the website, products, and services offered by Flexspac LLC ("Flexspac," "Company," "we," "us," or "our"), collectively referred to as the "Services."

Flexspac operates an online store offering dietary supplements and wellness products, including Flexspac Beetroot.

These Terms should be read together with our Privacy Policy, 30-Day Money-Back Guarantee & Refund Policy, Shipping Policy, Legal Notice, and any other terms or disclosures presented to you in connection with a purchase.

By accessing or using our website, you agree to comply with the provisions of these Terms that apply to website use.

By placing an order after being presented with these Terms or a link to them, you agree to the terms applicable to your purchase.

If you do not agree to these Terms, do not use the Services or place an order.

1. Eligibility

Individual experiences and responses to dietary supplements vary. We do not guarantee that any customer will experience a particular health, wellness, energy, circulation, cardiovascular, exercise, or performance result.

3. FDA & Medical Disclaimer

Statements regarding our dietary supplements have not been evaluated by the Food and Drug Administration unless expressly stated otherwise.

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

Nothing provided through the Services constitutes medical advice, diagnosis, treatment, or a recommendation to begin, discontinue, replace, or alter any medication or medical treatment.

• Shipping restrictions;

Discounts, promotional codes, bundle offers, gifts, free shipping offers, and other promotions may:

Unless expressly stated otherwise, promotions may not be combined.

If a product is listed at an obviously incorrect price because of a technical or typographical error, we may cancel the order before acceptance and refund any amount already charged.

We will not substitute a higher price without your authorization.

9. Payments

You agree to provide current, complete, and accurate billing information.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charge for your order.

Payments may be processed through third-party providers such as:

• Shopify Payments;

• Credit and debit card processors;

• PayPal; or

• Other payment methods displayed at checkout.

Flexspac does not generally receive or store your complete payment-card number.

Your use of a third-party payment service may also be subject to that provider's applicable terms.

10. Taxes

Applicable sales, use, or other transaction taxes may be calculated and collected where required by law.

The amount displayed at checkout will reflect applicable charges known to us at the time of purchase.

For international orders, if offered, customers may be responsible for duties, customs fees, import taxes, or similar governmental charges where disclosed or required by applicable law.

11. Shipping and Delivery

Shipping options, estimated delivery periods, and applicable shipping charges will be displayed at checkout or otherwise described in our Shipping Policy.

Delivery estimates are estimates rather than guarantees unless we expressly state otherwise.

Delays may occur because of circumstances including:

• Carrier disruptions;

• Weather;

• Holidays;

• Incorrect address information;

• Customs processing;

• Natural disasters;

• High-volume periods; or

• Other circumstances reasonably outside our control.

Nothing in these Terms limits obligations we may have under applicable law regarding timely shipment or delivery.

Ownership, responsibility, and risk of loss relating to shipped products will transfer as provided by applicable law rather than through any provision intended to waive non-waivable consumer rights.

12. Missing, Lost, or Delivered Packages

Carrier tracking information may be used as evidence of shipment or delivery, but a package being marked "delivered" does not automatically prevent you from contacting us regarding a legitimate delivery problem.

If you believe your package has been lost, misdelivered, stolen, or damaged in transit, contact us as soon as reasonably possible at info@flexspac.com.

We may ask you to:

• Confirm your shipping address;

• Check surrounding delivery areas;

• Check with household members or neighbors;

• Contact the carrier;

• Provide photographs or other relevant information; or

• Cooperate with a carrier or shipping claim.

We will handle shipping issues in accordance with our Shipping Policy and applicable law.

Flexspac is not responsible for losses caused by intentionally or materially incorrect shipping information supplied by the customer, except where otherwise required by law.

13. Customer Shipping Information

You are responsible for providing a complete and accurate delivery address.

If you discover an address error, contact us immediately.

We cannot guarantee that an address can be changed after an order enters processing or fulfillment.

If a shipment is returned because of an incorrect or incomplete address provided by the customer, additional reasonable shipping costs may apply before reshipment.

14. Order Cancellations

We begin processing orders promptly.

If you wish to modify or cancel an order, contact us at info@flexspac.com as soon as possible.

We cannot guarantee cancellation or modification after an order has entered processing, fulfillment, or shipment.

If an order can no longer be canceled, it may still qualify for return or refund under our 30-Day Money-Back Guarantee & Refund Policy.

15. 30-Day Money-Back Guarantee

Eligible purchases of Flexspac Beetroot are covered by our 30-Day Money-Back Guarantee, subject to the terms of our separate Refund Policy.

The 30-day period begins on the date the applicable shipment is recorded as delivered.

For multi-bottle orders, one bottle may be opened and reasonably used to evaluate the product. Additional bottles included in a full-order refund request may be required to remain unopened and unused.

Eligibility, return requirements, shipping costs, exclusions, and refund procedures are governed by the Flexspac 30-Day Money-Back Guarantee & Refund Policy in effect for the applicable order.

If marketing materials provide rights that are more favorable than these Terms, Flexspac will honor the applicable advertised guarantee to the extent required by law.

16. Subscriptions and Recurring Orders

This section applies only if Flexspac offers a subscription, recurring-delivery program, or automatic-renewal option and you affirmatively select that option.

A subscription is not required to make a purchase unless a particular offer clearly states otherwise before checkout.

If you knowingly enroll in a recurring-order program, you authorize Flexspac and its payment providers to charge the payment method you provide at the price and frequency clearly disclosed to you before enrollment, including applicable taxes and disclosed shipping charges.

Before enrollment, applicable subscription information will identify material terms such as:

• The recurring price;

• Billing frequency;

• Shipment frequency;

• How long the subscription continues;

• How to cancel; and

• Any material promotional or introductory terms.

Your subscription will continue until canceled unless another duration is expressly disclosed.

You may cancel a subscription using the cancellation method provided with the applicable program or by contacting info@flexspac.com.

Cancellation stops future eligible renewals. It does not automatically reverse an order that was already processed before the cancellation became effective.

An already processed recurring order may still qualify for a refund under our Refund Policy.

We will not intentionally enroll a customer in a paid recurring program solely because the customer failed to opt out.

Where applicable law requires additional renewal notices, consent, cancellation mechanisms, or other protections, those requirements will apply.

17. Product Use and Customer Responsibility

You agree to use Flexspac products:

• Only for their intended purpose;

• According to the directions on the product label;

• Within any applicable serving recommendations; and

• Consistently with product warnings.

You should not intentionally exceed the recommended use in an attempt to obtain greater or faster results.

You are responsible for determining, with professional medical advice when appropriate, whether a dietary supplement is suitable for your individual circumstances.

Flexspac is not responsible for harm caused by intentional misuse, unauthorized alteration, improper storage after delivery, use contrary to clearly stated warnings, or other misuse to the extent permitted by applicable law.

Nothing in this section excludes liability that cannot lawfully be excluded.

18. No Guaranteed Results

Customer experiences differ.

Reviews, testimonials, case studies, photographs, videos, or statements describing an individual's experience do not constitute a guarantee that another customer will experience the same result.

Any typical-results, testimonial, endorsement, or similar disclosures presented with advertising or customer content form part of the applicable representation.

Flexspac does not guarantee particular:

• Blood-pressure readings;

• Medical outcomes;

• Medication changes;

• Energy levels;

• Circulation outcomes;

• Athletic performance;

• Cardiovascular outcomes; or

• Other individual health results.

Nothing in our advertising should be interpreted as directing a customer to discontinue prescribed medication or substitute a Flexspac supplement for medical treatment.

19. Accounts and Account Security

If customer accounts are available, you are responsible for maintaining the confidentiality of your account credentials.

You agree to notify us promptly if you reasonably suspect unauthorized access to your account.

We may suspend or restrict an account when reasonably necessary to investigate suspected fraud, security threats, unauthorized activity, or violations of these Terms.

20. Reviews, Feedback, and User Content

If you voluntarily submit a review, testimonial, photograph, video, comment, suggestion, or other content to Flexspac, you represent that:

• The content reflects your genuine experience or opinion;

• You have the right to submit it;

• It does not knowingly violate another person's rights; and

• It is not intentionally false, fraudulent, defamatory, unlawful, or misleading.

Where you authorize content for promotional use, you grant Flexspac a non-exclusive, worldwide, royalty-free license to reproduce, display, distribute, format, and use that content in connection with our business, marketing, and Services, subject to applicable law and any limitations agreed to when the content was submitted.

We will not knowingly edit a testimonial in a manner that materially misrepresents the endorser's actual experience or opinion.

If you received compensation, free products, discounts, or another material benefit in connection with an endorsement, appropriate disclosure may be required.

21. Intellectual Property

The Flexspac name, logos, original website design, original advertising materials, photographs, videos, text, graphics, product presentation, and other proprietary content are owned by Flexspac LLC or used under license or other lawful authorization.

Except as permitted by applicable law, you may not without prior written permission:

• Copy;

• Reproduce;

• Republish;

• Modify;

• Distribute;

• Sell;

• License;

• Scrape for commercial exploitation;

• Create unauthorized derivative works from; or

• Commercially exploit

our protected content.

Third-party trademarks and intellectual property remain the property of their respective owners.

22. Prohibited Uses

You may not use the Services to:

• Commit fraud;

• Make unauthorized purchases;

• Attempt to interfere with website security;

• Introduce malicious code;

• Scrape or harvest personal information unlawfully;

• Impersonate another person;

• Infringe intellectual-property rights;

• Submit knowingly false information;

• Circumvent purchase limits;

• Abuse promotional offers;

• Engage in unauthorized resale;

• Make false claims of affiliation with Flexspac; or

• Violate applicable law.

We may restrict access or cancel transactions where we reasonably determine that prohibited conduct has occurred.

If you separately provide your telephone number and affirmatively consent to receive marketing text messages from Flexspac, you may receive recurring automated or non-automated messages such as:

• Promotional offers;

• Product announcements;

• Cart reminders; or

• Other marketing communications described when you opt in.

Consent to receive marketing text messages is not a condition of purchase.

Message frequency may vary. Message and data rates may apply.

You may opt out of marketing text messages by replying STOP or following another cancellation method provided in the applicable message.

You may unsubscribe from promotional emails using the unsubscribe link provided in those messages.

Unsubscribing from marketing does not prevent us from sending transactional messages reasonably necessary to fulfill an order, respond to a request, communicate safety information, or administer your account.

25. Third-Party Services

Our Services may use or link to third-party providers such as:

• Shopify;

• Payment processors;

• Shipping carriers;

• Fulfillment providers;

• Analytics services;

• Advertising platforms;

• Review platforms; and

• Communication providers.

Third parties may operate under their own terms and privacy policies.

Flexspac is not responsible for the independent acts or omissions of a third party to the extent those acts are outside our reasonable control, except where applicable law provides otherwise.

27. Website Availability

• Errors;

• Technical failures; or

• Security incidents.

We may modify, maintain, suspend, or discontinue website functionality where reasonably necessary.

28. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND DIGITAL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE COMPLETELY ERROR-FREE, UNINTERRUPTED, OR FREE FROM ALL HARMFUL COMPONENTS.

WITH RESPECT TO PRODUCTS, THIS DISCLAIMER DOES NOT LIMIT:

• Our express 30-Day Money-Back Guarantee;

• Any express warranty we specifically provide;

• Rights relating to defective or nonconforming goods; or

• Any warranty, consumer right, or remedy THAT CANNOT LAWFULLY BE DISCLAIMED.

29. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FLEXSPAC LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, FLEXSPAC'S AGGREGATE LIABILITY ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO FLEXSPAC FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

Nothing in these Terms is intended to limit rights or remedies arising from fraud, intentional misconduct, or any other liability that applicable law does not permit us to exclude.

30. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Flexspac LLC from third-party claims, losses, or reasonable expenses arising directly from:

• Your intentional or unlawful misuse of the Services;

• Your unauthorized resale, relabeling, or alteration of Flexspac products;

• Content you submit that infringes another person's rights;

• Fraud committed through your account; or

• Your material violation of these Terms or applicable law.

This provision does not require you to indemnify Flexspac for claims arising solely from Flexspac's own negligence, wrongdoing, defective product, or other conduct for which indemnification may not lawfully be imposed.

31. Fraud, Chargebacks, and Payment Disputes

If you believe a charge is incorrect, we encourage you to contact info@flexspac.com so we can review the issue.

Nothing in these Terms prevents you from exercising any lawful right to dispute a transaction with your financial institution.

However, knowingly submitting false information in connection with a payment dispute, seeking duplicate reimbursement through both Flexspac and a financial institution, or otherwise engaging in payment fraud is prohibited.

If a chargeback is pending for a transaction, we may pause a separate refund relating to the same transaction while the dispute is being resolved to avoid duplicate reimbursement.

32. Suspension and Termination

We may restrict or terminate access to the Services where reasonably necessary because of:

• Fraud;

• Abuse;

• Security threats;

• Illegal conduct;

• Unauthorized resale; or

• A material violation of these Terms.

Termination does not eliminate rights or obligations that arose before termination.

Provisions that by their nature should survive termination will continue to apply.

33. Dispute Resolution and Informal Resolution

Before filing a lawsuit relating to a dispute with Flexspac, you and Flexspac agree, where legally permitted, to make a reasonable good-faith effort to resolve the dispute informally.

You may begin the process by sending a written description of the dispute, your order number if applicable, and the relief requested to:

Either party may proceed with available legal remedies if the dispute is not resolved informally within a reasonable period.

Nothing in this section prevents either party from:

• Seeking relief in small claims court where eligible;

• Seeking emergency or injunctive relief where appropriate;

• Exercising a non-waivable statutory right; or

• Making a report or complaint to a governmental or regulatory authority.

34. Governing Law

These Terms and disputes arising from them are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, except where federal law applies or the law of another jurisdiction provides consumer protections that cannot lawfully be waived.

To the extent legally permitted and unless another dispute procedure is expressly agreed to, judicial proceedings relating to these Terms may be brought in a court of competent jurisdiction located in Florida.

Nothing in this section deprives a consumer of jurisdictional or venue rights that cannot lawfully be waived.

35. Severability

If a provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in effect to the extent legally permitted.

36. No Waiver

If Flexspac does not immediately enforce a provision of these Terms, that does not constitute a permanent waiver of that provision or any other right.

Any waiver must be authorized by Flexspac and applies only to the specific circumstances for which it was given.

37. Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent where such consent may lawfully be required.

Flexspac may assign these Terms in connection with a merger, acquisition, financing, sale of assets, corporate restructuring, or transfer of the business, subject to applicable law.

38. Entire Agreement

These Terms, together with the policies and disclosures incorporated into them, constitute the agreement between you and Flexspac relating to the matters they cover.

If a product page, promotion, checkout disclosure, guarantee, or other specific written term gives you greater rights than a general provision of these Terms, the more specific representation will control for that particular transaction to the extent required by law.

39. Changes to These Terms

We may update these Terms to reflect changes to our Services, business practices, products, or applicable requirements.

Changes will be posted with an updated effective date.

Changes will generally apply prospectively rather than materially changing an already completed transaction, except where required by law or expressly agreed to.

Your continued use of the website after revised Terms become effective constitutes acceptance of the revised website-use terms to the extent permitted by applicable law.
